An Application has been filed by the applicants for recalling the order dated 30.01.2023, by which the Hon’ble Tribunal had granted interim relief to the applicants, subject to deposit of 25% of the amount due. The further stipulation was made that if the applicants do not deposit the said amount within a week, the Appeal shall be considered to have been dismissed for want of pre-deposit, without reference to the Hon’ble Tribunal, since the applicant had not deposited any amount, therefore, the appeal was treated to have been dismissed vide order dated 07.02.2023 by the Ld. registrar.
The applicants have now filed an Urgency Application being I.A. No. 1320/2023 stating that the applicants are neither borrowers nor guarantors in the present case, therefore, they are not obligated to deposit any amount as ordered by this Hon’ble Court.
In view of the above, let the matter be placed before Hon’ble Chairperson on 20.03.2023 for further orders.
