Shri Ram Krishna Yadav, holding brief of Shri Rohan Gupta, Ld. Counsel for the appellant is present and files authorization letters.

The appellant had deposited court fee of Rs. 9,000/- with the appeal. The registry pointed out that the court fee of Rs. 91,000/- more is required. In this regard the Ld. Counsel stated that the appellants are neither borrower nor guarantor. Hence, court fee of Rs. 1.00 lacs is not applicable in their case. Ld. Counsel for the appellant provides D. D. Number 786788 dated 20.05.2022 (IndusInd Bank) of Rs. 50,000/- (Rupees Fifty Thousands only). As regards defect regarding certified copy of the impugned order Ld. Counsel stated that Photocopy of the impugned order has been filed with the Appeal and undertakes he will filed certified copy of the same. In regard to the defect regarding multiple defects Ld. Counsel states that the relief sought are inter related.

Ld. Counsel also files Waiver Application (I.A. No. 75/2022) with IPO of Rs. 200/-. In the Waiver Application it has been stated that appellants neither borrower nor guarantors. Hence, condition of pre-deposit is not applicable in their case. Ld. Counsel states that he will argue before the Hon’ble Chairperson.

This appeal has been filed against judgment dated 09.11.2021 of DRT, Lucknow, in S.A. No. 86/2020.
