Heard the learned counsels for the parties on the impleadment application being I.A. No. 138/2023.
Learned counsel for the respondent-Bank has no objection, if the impleadment application is allowed.
Accordingly, the impleadment application is allowed. Let the necessary amendment in the array of parties of memo be made. If such amendment is made, notices be issued to the newly added respondents by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
Learned counsel for the appellant contends that he is ready to deposit remaining amount, which is approximately Rs. 10.00 lacs.
Learned counsel for the respondent-bank submits that the total outstanding amount is approximately Rs. 33.00 lacs and he shall provide the statement of account on the next date.
The contempt application shall be considered on the next date.
List this case on 17.04.2023 for service.
