Learned counsel for the respondent-Bank submits that notice of the appeal has been served today, therefore, he seeks time to file reply of the same.
Learned counsel for the appellant contends that an amount of Rs. 8.50 lacs towards pre-deposit has already been deposited, which is not denied by the counsel for the respondent-bank.
Accordingly, the waiver application is allowed.
Learned counsel for the appellant contends that for the first time, the sale of the property in question is fixed 01.10.2022, therefore, the interim protection may be granted.
In view of the above, the parties concerned are directed to maintain the status quo qua the property in question, as it exists today, till next date.
List this case on 22.12.2022 for reply.
