Learned counsel for the appellant submits that the property in question is in possession of the Bank and he has already deposited more than the amount of pre deposit. Further, he is ready to deposit Rs. 10.00 lacs subject to condition that the possession of the property may be restored, as day to day condition of the property in question is being deteriorated.
Learned counsel for the respondent-Bank submits that the arguing counsel Shri R. K. Tiwari is out of station, therefore, prays for deferment.
