Learned counsel for the respondent-Bank submits that the order, which was passed by the District Magistrate in the proceeding under section 14, has been withdrawn by the Bank, therefore, the present appeal has become infructuous.
Learned counsel for the appellant submits that he is a copartner and his share in the property is to be determined, therefore, the appeal has not become infructuous.
Learned counsel for the respondent-Bank submits that he shall file a copy of the order with regard to the withdrawal of the proceeding under section 14 after serving copy of the same upon the counsel for the appellant, who may obtain instruction and file objection by the next date.
