Learned counsel for the appellant submits that he has already filed impleadment application being I.A. No. 171/2023 dated 01.03.2023 through e-filing and hard copy is being filed today in court for impleading M/s Bundelkhand Melting Ispat Pvt. and Smt. Neeta Gupta as appellants no. 2 & 3 in the present case.
Learned counsel for the appellant further submits that the order impugned is the order, by which the application for recalling the order dated 11.09.2017 was dismissed in default, therefore, as per judgment of the Hon’ble High Court passed in Writ-C No. 1634 of 2019-Jai Gopal Kansal and another Vs. Indian Bank & Another, decided on 12.03.2019, the full court fee is not required in the present case.
Learned counsel for the respondent-Bank prays for some time to file reply to the court fee as well as impleadment application. Let the same be filed by the next date.
As prayed, list this case on 21.04.2023 for hearing.
