It has been contended by the learned counsel for the respondent-bank that an undertaking was given on behalf of the appellant that he will clear entire outstanding dues and in this regard reference has been drawn to the earlier order of this court dated 02.06.2022, but no amount has been deposited.
Learned counsel for the respondent-Auction Purchaser submits that he has already deposited Rs. 1.80 crores and shall deposit the remaining balance amount within a week, if possession is handed over to him.
Learned counsel for the appellant submits that he has deposited Rs. 1.09 crores and undertakes to deposit the remaining balance amount within one month from today, failing which he concedes that appropriate action may be taken by the Bank in favour of the auction purchaser by giving possession after taking remaining amount of sale within a week thereafter.
In view of the above, list this case on 25.10.2023.
