The present urgency application being I.A. No. 119/2022 has been filed alleging that inspite of notice being issued to the Bank, no reply has been filed, but the Bank has sold the property to the guarantor of the appellant and the sale certificate dated 20.04.2022 has also been issued in favour of the auction purchaser, which is appended as annexure no. 2 to the present application.

It is further contended that the Bank was trying to take physical possession of the property in question and handover to the auction purchaser by 15.06.2022, but the learned counsel submits that no possession has yet been taken.

There is nothing on record to show that the Bank is trying/going to take the physical possession of the property in question, as there is only simple averment made by the appellant in the present application in this regard. However, let the appellant file some document showing that the Bank is trying to the take physical possession of the property in question. As such there is no ground, on which any order is required to be passed.

In view of the aforesaid, the urgency application is disposed off.
