Rejoinder has been filed on behalf of the appellant, copy of which has been given to the counsel for the respondent-bank today in court.

Learned counsel for the appellant contends that the Bank had auctioned the property, but it itself has purchased the same, therefore, the waiver application deserves to be allowed.

In view of the above, the waiver application stands allowed.

Learned counsel for the appellant has filed another affidavit dated 15.10.2022 after serving copy of the same to the counsel for the respondent-Bank, who may file response to the said affidavit by the next date. Till then the status quo qua the property in question, as it exists today, shall be maintained by all the parties concerned.

List this case on 24.01.2023 for reply.
