Present: Shri V. K. Shukla, counsel for the appellants, None for the respondent-Bank,
Shri Deepak Pachauri, counsel for the respondent-Auction Purchaser,
Learned counsel for the respondent-Auction Purchaser submits that inspite of last opportunity being granted to the respondent-Bank, no reply has been filed till date. Therefore, right of the Bank to file reply may be closed and the case may be listed for hearing.
Perusal of the earlier order dated 15.03.2022 shows that further two weeks’ time was granted to the respondent-Bank for filing reply, but no reply has been filed on their behalf in spite of several opportunities being granted, hence right of the Bank to file reply stands closed. Reply of the respondent no. 2 is on record, to which the rejoinder has already been filed by the counsel for the appellant.
List this case on 28.07.2022 for hearing. Till then the interim order, if any passed earlier, shall remain in operation.
