Present: Shri Ashok Pandey, counsel for the appellant, Shri S. K. Srivastava, counsel for the respondent-Bank, None for the respondent no. 2, None for the respondent no. 5,
Office report dated 25.07.2022 shows that no proof of publication has been filed with regard to the service of notice upon the respondent nos. 3 & 4. The said report further shows that no reply has been filed on behalf of the respondent no. 1, 2 & 5 inspite of three opportunities being granted.
Learned counsel for the appellant files affidavit of service along with proof of publication with regard to the respondent nos. 3 & 4.
Learned counsel for the respondent-Bank submits that the reply is under preparation, which shall be filed by the next date after serving the copy to the counsel for the appellant.
In view of the above, as last opportunity, learned counsel for the respondents no. 1, 2 & 5 may file reply by the next date, failing which appropriate order shall be passed.
List this case along with Appeal Dy. No. 172/2020 on 19.10.2022 for reply.
