Pursuant to the earlier order dated 18.07.2022 of this Tribunal, notices were issued to the respondents. The office report dated 20.09.2022 shows that notice sent to the respondent no. 2 has returned back on account of insufficient address and the notices sent to the respondent nos. 3 & 4 have been served. The notice sent to the respondent no. 5 has also returned back with remark “door locked”.

The delay condonation application being I.A. No. 175/2022 and exemption application being I.A. No. 173/2022 are pending consideration.

Let the appellant take fresh steps for service of notice upon the respondent nos. 2 & 5 within 15 days by publication in the newspapers having wide circulation in the area. Affidavit of service along with proof of publication be filed by the next date.

Learned counsel for the respondent-Bank submits that the copy of memo of appeal has not been served upon him. Learned counsel for the appellant is directed to serve the same upon the counsel for the respondent-Bank within 48 hours, who may file reply by the next date.

The respondent nos. 3 & 4 may put in appearance and file reply by the next date.
