Present: Shri Sikhar Chandra, counsel for the appellant,

Three applications i.e. I.A. No. 371/2022 for stay, I.A. No. 372/2022 for waiver and I.A. No. 370/2022 for expediting the matter have been filed by the appellant.

Learned counsel for the appellants submits that the appellants are neither borrowers nor guarantors to the financial assistance granted by the respondent no. 1. It is further contended that the appellants have purchased the property from the respondent no. 4 on 27.01.2016 for value and since then they are in possession of the said property. It is also contended that the respondent-FI is about to take possession of the property in question as is apparent from the notice dated 13.09.2022, copy of which has been appended at page no. 143-A of the memo of appeal, therefore, the learned counsel prays that the Bank may be restrained from taking possession of the property in question till final decision of this appeal.

Till the next date of listing, the parties concerned are directed to maintain the status quo qua the property in question, as exists today.
