Shri Ajay Kumar Patel, Ld. Counsel for the appellant appears on behalf of the appellant and submits that he has filed an Application praying that he may be exempted from providing the certified copy of the impugned order. However, he undertakes to supply the same as and when he receives the same from the DRT, concerned.

The prayer made by the counsel for the appellant is allowed and he is directed to supply the same as early as possible, latest by 25.07.2022.

Learned counsel for the appellant further submits that by the impugned order, the appellant has been directed by the Tribunal below to deliver the physical possession of the property auctioned by the Bank in SARFAESI proceedings. Hence, there is urgency in the matter, therefore, he prays that the case may be listed before the Hon’ble Tribunal at the earliest.

The instant Appeal is filed by Bank under section 20 of the RDB Act against judgment dated 20.05.2022 of DRT, Ranchi in T. A. No. 01 of 2022. Urgency Application (I.A. No. 174/2022), Exemption Application (I.A. No. 173/2022) and Delay Condonation Application (I.A. No. 175/2022) have been filed along with Appeal.

In view of the submission made by the learned counsel for the appellant and the fact that he has filed an Urgency Application along with the memo of appeal, let the case be listed before the Hon’ble Chairperson for limitation on 11.07.2022.
