No pre deposit has been made. Waiver Application has been filed. Ld. Counsel files a Photocopy of order dated 22.04.2014 which indicates that Bank filed O.A. for recovery of Rs. 46.00 lakhs. Further, the appellant has also mentioned in Para 21 of the Appeal that the amount of debt as determined by DRT, Patna in O.A. No. 157 for 2013 is Rs. 46,78,039/-. In the Waiver Application it has been mentioned that the Bank auctioned the property in Rs. 1,57,65,000/-. Ld. Counsel states that he will argue before the Hon’ble Court.
The instant Application has been filed under section 20 of the RDB Act against final order dated 13.10.2022 of DRT, Patna in Appeal No. 07/2018. Urgency Application (I.A. No. 530/2022), Waiver Application (I.A. No. 531/2022) have been filed.
