Ghazipur, from allegedly harassing him and shielding anti-social elements. Backdrop: FIR No. 132/2024 (Sections 376 IPC and 4 POCSO Act) registered on his minor daughter's accusation of rape against tenant Gaurav, who died by suicide; FIR No. 170/2024 (Sections 306/34 IPC) subsequently registered against the Petitioner on the deceased's mother's complaint, with the Petitioner on bail; and an FIR under Section 223(a) BNS registered against his wife (Urmila Bhati) for failure of tenant verification (FIR No. 286/25 per the status report). Perusing the State's status report filed in compliance with the Court's order dated 05.08.2025, the Court found that the allegations of threat and harassment were not supported by any credible material, noted the admission of the Petitioner's family having beaten the deceased prior to the hanging, the pattern of numerous false or unsubstantiated complaints, and concluded that the conduct reflected a clear misuse of the State machinery seemingly intended to intimidate law enforcement and obstruct due process; finding no basis for apprehension warranting directions, the petition was dismissed.
