The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 482 of the Code of Criminal Procedure, 1973) seeks quashing of FIR No. 38/2025, registered at Cyber Police Station North West under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023¹ and all consequential proceedings emanating therefrom. The request for quashing is premised on a settlement between the Petitioner and the Complainant. 2. Counsel for the Petitioner submits that although the Petitioner does

not admit to any culpability, in order to amicably resolve the dispute, a sum of INR 15,000/-, being the alleged cheated amount, along with the laptop forming the subject matter of the FIR, have been returned to the Complainant.

The Complainant has no objection to the quashing of the FIR, as confirmed by her on the previous date as well as by her counsel appearing on her behalf.

Nonetheless, Mr. Amol Sinha, ASC for the State, submits that although the Petitioner may not be the direct beneficiary of the alleged cheated amount, the investigation is still underway. Efforts are being made to trace the actual recipient of the cheated amount, the FIR cannot be quashed at this preliminary stage.

In these circumstances, counsel for the Petitioner, states that she would like to withdraw the present petition and seeks liberty to apply at a later stage.

Dismissed as withdrawn along with pending application(s), if any, with liberty as aforesaid.
