The present petition has been filed under Section 29A (4) (5) of the Arbitration and Conciliation Act, 1996 read with Section 151 of CPC seeking an extension of the mandate for completion of the arbitral proceedings. The three-member arbitrator tribunal was constituted vide order dated 12.01.2022 in Arb.P. No. 1123/2021. Pleadings were completed on 18.06.2022. The parties mutually extended the time till 16.12.2023. The proceedings before the learned Tribunal are at the advanced stage.

Learned Tribunal vide order dated 19.09.2023 had directed both the parties to move an appropriate application for seeking an extension of time by a period of Nine months w.e.f. 16.12.2023.

Learned counsel for the petitioner submits that petitioner No.2 and 3 states that the respondent company is a joint venture company constituted by the petitioners.

Given the submissions made and the directions passed by the learned Arbitral tribunal, the mandate is extended by a period of nine months w.e.f. 17.12.2023 till 16.09.2024. The period from 16.12.2023 is also regularized.

In view of the above, the present petition along with pending application stands disposed of.
