The present petition has been filed on behalf of the Petitioners- MEP Infrastructure Developers Ltd. and MEP Chennai Bypass Toll Road Pvt. Ltd. under Section 29A of the Arbitration and Conciliation Act, 1996. The Petitioners vide the present petition are seeking extension of the mandate of the ld. Arbitral Tribunal till 30th June, 2024.

A brief background of the case is that the parties on 14th January, 2013 entered into a Concession Agreement in respect of the Project Highway to operate, maintain and transfer the Chennai Bypass Phase-I and II for the 9 years concession period (hereinafter ‘Agreement’). Disputes arose between the parties and in terms of Article 36 of the Agreement arbitration was invoked. Further, the ld. Arbitral Tribunal entered reference on 14th May, 2019.

Ld. Sr. Counsel for the Petitioner submits that in terms of the email dated 28th March, 2024 sent by the Arbitral Tribunal, the Tribunal requires three months more to pronounce the award. There is no objection from the Respondent.

Accordingly, the mandate of the Tribunal is extended with effect from 1st April, 2024 till 30th June, 2024.

Petition is disposed of with all pending applications, if any.
