The petitioner has preferred this writ petition under Article 226 of the Constitution of India, seeking following relief(s):-

“10.1 That this Hon'ble Court pleased be Issue a writ of mandamus directing the Respondents to immediately stop the ongoing unauthorized construction being carried out on

the Government land situated in Village Tikari, Tehsil Masturi, District Bilaspur.

10.2 That this Hon'ble Court may kindly be pleased to issue direction to the Respondent No. 1 to 4 to conduct spot inspection and remove the illegal encroachment/ construction from the Government land forthwith, in accordance with law.

10.3 That this Hon'ble Court may kindly be pleased to issue direction to the authorities to ensure that no further unauthorized construction is carried out on the said Government Land in future and also Grant police assistance, if required, for effective compliance of the directions issued by this Hon'ble Court.

10.4 That the Hon'ble Court may kindly be pleased to grant any other relief as it may deems fit and appropriate.”

Learned counsel for the petitioner submits that, the petitioner is an owner of land and occupant of land bearing Khasra No. 259/5 and 261/2 admeasuring about 39 decimals situated at village Tikari, Patwari Halka No. 33, Tehsil Masturi, Distt. Bilaspur. He further submits that some villagers have dug pit over the government land which is situated in front of aforesaid land of the petitioner. The petitioner has filed an representation (Annexure P-3) before the Tehsildar/ respondent No. 4 to prevent encroachment over the government land, but no appropriate order has been passed by it. Hence he submits that, this writ petition may be disposed of directing

the Tehsildar Masturi/respondent No. 4 to take action on the representation (Annexure P-3) dated 4-4-2025 filed by the petitioner within stipulated period.

Learned counsel appearing for the State submits that, in pursuance of the representation filed by the petitioner, the Naib Tehsildar, Masturi has sought report from concerned Patwari as per Annexure P-4 and appropriate order shall be passed by the Tehsildar/Naib Tehsildar in the representation filed by the petitioner.

Heard learned counsel for the parties.

Having considered the limited prayer made by counsel for the petitioner, which is not opposed by the State Counsel, this writ petition is disposed off at this stage directing respondent No.4 to consider and decide the pending representation dated 4-4-2025 of the petitioner (Annexure P-3) in accordance with law, preferably within an outer limit of '30 days' from the date of receipt of copy of this order.

With aforesaid observation and direction, the writ petition stands disposed off.

Pending interlocutory application(s), if any, also stands disposed off.
