1) The present criminal revision is against impugned judgment of conviction and order of sentence dated 03.04.2025 passed in Criminal Appeal No.120/2024 by the learned Fifth Additional Sessions Judge, Janjgir, District Janjgir Champa (C.G.) whereby the learned Court upheld the judgment and order passed by learned Judicial Magistrate First Class, Janjgir, District Janjgir

Champa dated 05.10.2024 and applicant has been convicted and sentenced to undergo rigorous imprisonment for six (06) months and directed to pay a fine of Rs. 9,00,000/- to be deposited within 30 days with default stipulations.

2) The complainant and the applicant (accused) are present in person/through their respective Advocates. The parties have voluntarily arrived at an amicable settlement without any force, coercion or undue influence. The terms and conditions of the settlement have been read over and explained to the parties, who admit the same to be true and binding upon them. Their identities have been verified.

3) Accordingly, in terms of the compromise, the following award was passed:

(i) A cheque of Rs.7,50,000/- was issued by the applicant(accused) in discharge of liability which was dishonoured;

(ii) The applicant has already deposited a sum of Rs.7,50,000/with the learned Trial Court;

(iii) They have arrived at an agreement to the effect that out of Rs.7,50,000/- deposited with the Court below; Complainant/Gopal Prasad Rathore will get a sum of Rs.5,50,000/- and applicant/accused will receive a sum of Rs.2,00,000/-.

(iv) The complainant agrees that upon receipt of Rs.5,50,000/which is lying with the learned Trial Court, he shall have no further claim against the applicant arising out of the cheque in question

and orders of sentenced by the learned Courts dated 03.04.2025 and 05.10.2024 are hereby set aside.

4) The learned Lower Court shall release an amount of Rs.5,50,000/in favour of the Complainant/Gopal Prasad Rathore and Rs.2,00,000/- in favour of the applicant/accused/Bhagvat Prasad Lahmor.

5) Accordingly, the instant CRR stands disposed off.
