judgment of conviction dated 25.10.2016 passed in Criminal Appeal No. 117/2015 by the learned Additional Sessions Judge (F.T.C.) Dhamtari, District Dhamtari C.G. whereby, the applicant has been convicted under Section 138 of Negotiable Instrument Act and directed to pay the Rs. 5,50,000/- as compensation to complainant and Rs. 10,000/- would be adjusted, which applicant has already deposited before the learned Trial Court within a period of one month, in default of payment of compensation 6 months S.I.

1. The parties have voluntarily arrived at an amicable settlement without any force, coercion or undue influence. The terms and conditions of the settlement have been read over and explained to the parties, who admit the same to be true and binding upon them. Their identities have been verified.

1. Accordingly, in terms of the compromise, the following award is passed:-

i. The applicant/accused has already deposited a sum of Rs. 50,000/- today itself through UPI.

¶26

ii. Rs. 1,50,000/- will be paid to the applicant by 18.09.2026 in three installments.

iii. The applicant has handed over the Renault Kwid Car bearing registration No. CG 27 H 1684 to the nonapplicant and he is further agreed to transfer ownership of Car in favour of the applicant and will bear the expenses incurred in transfer. The non-applicant shall have no further claim against the applicant/accused arising out of the cheque in question.

iv. The complaint under Section 138 of the Negotiable Instruments Act stands disposed of in terms of this settlement.

v. In the event of default in payment of any installment or payment of agreed amount settled between the parties within stipulated time, the complainant shall be at liberty
