1) The present criminal revision is against impugned judgment of conviction and order of sentence dated 20.2.2025 passed in Criminal Appeal No. 32/2024 by the learned Third Additional Sessions Judge, Ambikapur, District Sarguja whereby the learned Court upheld the judgment and order passed by learned Judicial

Magistrate First Class, Ambikapur, District Sarguja dated 27.7.2024 in Criminal (Complaint) Case No.1296 of 2017 and the applicant has been convicted and sentenced to undergo simple imprisonment for six (06) months and directed to pay a fine of Rs.1,50,000/- to be deposited within a period of two months with default stipulations.

2) The parties have voluntarily arrived at an amicable settlement without any force, coercion or undue influence. The terms and conditions there of have been read over and explained to them, and they have admitted the same to be true and binding upon them. The identities of the applicant and the non-applicant have been verified. Accordingly, in terms of the compromise, the following award has been passed:

1. A cheque of Rs.1,08,000/- was issued by the applicant in discharge of liability, which was dishonoured.

2. The applicant/ accused has already deposited a sum of Rs.75,000/- before the learned trial Court pursuant to the interim order dated 3.3.2025.

3. The applicant/ accused agreed to issue a cheque of Rs.75,000/- bearing cheque No.”003001” 497026001 : 554600” 31 in favour of the complainant. The complainant has agreed with the terms of settlement and states that he shall have no further claim against the accused arising out of the cheque in question after receipt of Rs.1,50,000/- in total. Accordingly, the present petition stands disposed of in terms of this settlement.

3) In the event of default in payment of any installment or the entire

settled amount within the stipulated time, the complainant shall be

at liberty to enforce this Lok Adalat Award in accordance with law.

4) The complainant would be at liberty to withdraw the amount of Rs.75,000/- already deposited by the applicant/ accused before

the learned trial Court.

5) Accordingly, the instant CRR stands disposed.
