Petitioner in person, who is present before this Court would submit that vide order dated 23/06/2008 (Annexure P/2), he was initially appointed on the post of ‘Shiksha Karmi Grade -III’ and thereafter as ‘Shiksha Karmi Grade -I’ vide order dated 29/09/2010 (Annexure P/3). Since the

benefit of work of lower post was denied to the petitioner, he preferred a writ petition (WPS No.3395/2018) before this Court, which was allowed on 30.04.2018 directing respondents to provide the benefit of revised pay-scale on completion of 08 years of services rendered by the petitioner. Subsequently, vide order dated 06.03.2019 (Annexure P/5), petitioner has been granted benefit of 08 years of service w.e.f. 23/06/2016. He further contended that services of other teachers were absorbed in School Education Department in the year 2018, but petitioner’s services was absorbed in School Education Department on 01.07.2019 and, therefore, in gradation list name of the petitioner is reflected much below to his juniors. Petitioner is also entitled for absorption in School Education Department from the year 2018 and raising said ground, he already submitted representation Annexure P/1 before the concerned respondent-authority on 13.07.2023, but till date same has not been considered and decided. Hence, it is prayed that this writ petition may be disposed of directing respondent No.3/Director to decide the pending representation of the petitioner and take a decision, at the earliest within specified time.

Learned State Counsel submits that she is having no objection to the limited prayer made by petitioner in person.

Considering facts of the case, limited prayer made by petitioner in person and not opposed by learned State Counsel, writ petition stands disposed of at this stage directing respondent No. 3 to decide the pending representation dated 13.07.2023 (Annexure P/1) and take a decision in accordance with law and relevant rules, within an outer limit of ‘ 90 days’ from the date of receipt copy of this order.
