Learned counsel appearing for the petitioner submits that the petitioner was appointed as a daily wage employee in the year, 1980, thereafter, his services was retrenched. He further submits that they approached

before the Labour Court and his services was reinstated in the Water Resources Department, Division Chhuikhadan. He further submits that services of similarly situated other persons were already regularized by the respondents. He further prayed that the respondents authority may also be directed to consider the matter of petitioner for his regularization.

On the other hand, learned State Counsel opposed the arguments advanced by learned counsel for the petitioner and submits that the present writ petition is pending for consideration before this Hon’ble Court which may be a reason for non-consideration of the case of petitioner for regularization.

I have heard learned counsel appearing for the parties and perused the documents available on record.

Taking into consideration the fact that petitioner was appointed as Labourer in the year 1980 and the fact that other similarly situated persons have been granted benefit of regularization, it would be appropriate to dispose of the petition with a direction to the respondent authority to also consider the matter of the petitioner and take a decision within an outer limit of ‘six months’ from today.

With the aforesaid observations and directions, the instant petition is hereby disposed of.
