Heard.

1 It is submitted by learned counsel for the petitioner that pursuant to the advertisement dated 04.05.2023, petitioner participated and cleared the written examination for the post of Assistant Teacher under ‘E’ and ‘T’ cadre. His overall rank was 1339 under General Category. After selection, on the basis of directions issued by the respondents, the petitioner and other candidates submitted their priority/preference.

2 The petitioner is a local resident of Surguja division, who selected 130 schools for posting after appointment within Surguja division, however he has been given appointment for Sukma, Bastar division. Counsel for the petitioner further submits that petitioner as of now already joined the present place of posting i.e. Sukma, Bastar division. He further submits that after joining, petitioner gathered information through RTI, where it is known by him that the candidates whose rank were below than petitioner were given school in Surguja division itself. Further, as of now 445 schools are still vacant there, therefore, it is prayed by the counsel that petition may be disposed of giving liberty to the petitioner to make a representation before the respondent/competent authorities raising all above grounds and other grounds that he has raised in the petition and the respondent authorities in turn may also be directed to consider and decide the same in accordance with relevant rules and law within a stipulated period as fixed by this Court.

3 The said prayer of counsel for the petitioner is not opposed by the State counsel.

4 Considering the aforesaid submissions made by counsel for the parties, petition is disposed of permitting the petitioner to make a fresh representation before the respondent authorities within a period of 03 weeks and the respondent authorities in turn are directed to consider and decide the same within a further period of 90 days from the date of receipt of copy of this order in accordance with relevant rules and law.

5 With the aforesaid observation and direction, the present writ petition stands disposed of.
