It is submitted by the learned Counsel appearing for the petitioner that the petitioner has already been retired from his services on

30.09.2023 from the post of Sub-Engineer, Municipal Corporation, Chirimiri, but till date not any retiral benefits has been paid to the petitioner from the concerned respondents. Therefore, it is prayed by the petitioner that this petition may be disposed of giving liberty to the petitioner to submit a fresh representation before the respondents/ competent authority and upon submission of the such representation, respondents/competent authority may further be directed to consider and decide the same within a stipulated period as fixed by this Court.

Learned counsel appearing for Respondent No.3 submits that he has already made a proposal regarding retiral benefits and sent to Respondent No.2, therefore, direction should be issued to Respondent No.2 only.

In view of the above submissions made by learned counsel appearing for the petitioner, the present writ petition stands disposed of giving liberty to the petitioner to submit a fresh representation before Respondent No.2 within ‘two weeks’ from today and in the event of submission of the such representation, Respondent No.2 is directed to consider and decide the representation and clear the entire retiral benefits of the petitioner within ‘three months’ thereof in accordance with the law and relevant rules/circulars.

With the aforesaid direction, the present writ petition stands disposed of.
