. Heard the learned counsel appearing for the Petitioner. Prayers (ii) and (iii) which are substantive prayers in this PIL read thus :-

“(ii) The Respondents, through a Writ of Mandamus or any

Writ, Order or direction of any kind of such Writ or of any nature, may be issued against the Respondent, to restrain to issue fancy numbers to the Applicants, by twisting the procedure of law i.e. first come first service;

(iii) The Respondent be directed under the Writ of Mandamus, Order or Direction, to stop all the activities

of granting the fancy numbers to all the two wheelers and four wheelers at the price more than the lawful price under Indian Motor Vehicles Act.”

The learned Government Pleader relies upon the provisions of Rule 54-A of the Maharashtra Motor Vehicles Rules, 1989 and submits that the Rule permits the allotment of particular registration marks specified in Rule 54-A against the payment of the amounts mentioned in Rule 54-A. Rule 54-A also provides for a procedure for allotment of the specified registration marks.

In this PIL, there is no challenge to the validity of Rule 54-A of the Maharashtra Motor Vehicles Rules, 1989.

So long as the Rule 54-A continues to be there on the Rule book, reliefs claimed in this PIL cannot be granted. We, accordingly, reject the PIL. We make it clear that we have made no adjudication on the issue of legality and validity of the Rule 54-A of the Maharashtra Motor Vehicles Rules, 1989 and all questions on that behalf are kept open.
