The applicants have moved the application for the offences punishable under sections 324, 325, 323, 147, 148, 149, 504, 506 of the Indian Penal Code. The offence is registered at C.R. No.129 of 2014 with Tembhurni police station, Solapur. It is the case of the prosecution that on 18.6.2014, the informant and his uncle were collecting contributions for D.P. The accused did not pay the contribution and, therefore, when they went to them, they abused and there was quarrel on the earlier day. On 19.6.2014, at around 8am when the complainant was playing, at that time, both the accused alongwith one Narute arrived there with weapons. Gorakh assaulted him with iron rod on his arm. Then Satish and Dattatray assaulted him with kicks. There was scuffle when the applicant / accused

assaulted one Samadhan Kale, the uncle of the informant with stone on his head. Dattatray also hit Amol with stone and therefore, he lost his teeth. Thereafter, all the injured were shifted to hospital and on the same day, on 19.6.2014, he gave the FIR. The learned Counsel for the applicant submitted that the offence was registered initially under section 325 and subsequently under section 307 of the Indian Penal Code. He submitted that all the family members were made accused in this case and they are falsely implicated in the case. He prays that the applicant/accused be protected by pre-arrest bail.

Mrs.Mane, the learned Prosecutor and Mr.Sarda, learned Counsel appearing for the Intervener, have opposed the application. However, the injury certificate of Sambhaji Kale is produced, which shows that he was assaulted by the applicant/accused Satish with stone. It appears that there was a fracture of the skull. However, he was admitted in the hospital for 8 days. In view of the injuries sustained by the complainant and his relatives and considering the nature of the offence, I am inclined to grant pre-arrest bail to both the applicants as under:

i) In the event of arrest, the applicants be enlarged on bail on furnishing P.R. Bond in the sum of Rs.20,000/- each, with one or two sureties in the like amount;

ii) The applicants shall not tamper with the evidence;

¶21

iii) The applicants shall not indulge into any kind of criminal activity, especially against the complainant and his family members, while on bail;

¶22

iv) The applicants shall cooperate with the investigating officer and shall report to the concerned police station every Monday between 6pm to 7pm, till the filing of chargesheet.

Anticipatory Bail Application is disposed of accordingly.
