In view of the communication dated 21.2.2012 issued by the Deputy Secretary, Urban Development Department, Government of Maharashtra, to the Collector, Aurangabad, the grievance of the petitioner no more survives.

The said communication is taken on record and marked X for the purpose of identification.

The petition stands disposed of, in view of the said communication dated 21.2.2012. Needless to state that Respondent Nos. 4 and 5, who are duty bound to implement the decision of the State Govt., shall take action in accordance with law pursuant to the said communication.

We clarify that we have not considered any dispute between petitioner and Respondent No.4. The petition was entertained, since the action taken by Respondent-Municipal Council for removal of unauthorized construction was being interfered with by the Hon'ble Minister. If Respondent No. 6 is entitled to any of the remedies as available in law, the order passed by us would not come in his way. The action would be taken within a period of four weeks from today.

If the Municipal Council applies to the authorities of the police department, the authorities concerned shall grant necessary police protection for the purpose of implementation of the orders passed by the State Government.
