At the hearing, Mr. N.P.Deshpande, learned Assistant Government Pleader, places on record the communication dated 27 March 2012 from the Senior Accounts Officer in the office of the Principal Accountant General (Accounts & Entitlements)-I, Maharashtra, stating the following information regarding finalization of revision of pension cases of ex-Judicial Officers in light of Padmanabhan Committee Report:-

“A list showing the total number of Post 2006 retirees' revision cases received and the number of cases finalized with names are enclosed. The remaining cases would be finalized within a period of one month.

We have at present 181 cases of Pre-2006 retires. As for finalization of these cases, we need at least 4 to 6 months time for the reasons already indicated in our affidavit filed on 24^th February 2012.”

In view of the above, we dispose of this petition with a direction that the cases of ex-Judicial Officers for finalization of revision of pension in light of Padmanabhan Committee Report shall be finalized as expeditiously as possible and in any case by 31 July 2012.

It is clarified that the above direction will also apply to the Accountant General-II, Nagpur.

A copy of this order shall also be sent to the Principal District Judges in the State of Maharashtra, the Principal Judges of the Bombay City Civil Court, Family Courts and all other Courts and Tribunals in the State of Maharashtra with an observation that the said officers shall also expedite the steps which may be required to be taken by them for ensuring that the retired Judicial Officers get the benefits of the Padmanabhan Committee recommendations as early as possible and in any case within the above time limit.

A copy of this order shall also be sent to the concerned Treasury Officers requiring them to make disbursement after the revision of pension cases is finalized within one month from the date the case of the concerned retired Judicial Officer is finalized in light of Padmanabhan Committee recommendations.

If there is any delay in payment of arrears beyond 31 July 2012, the concerned authorities will be obliged to pay interest at the rate of 8% per annum from 1 August 2012 onwards.

The aforesaid Principal Judges shall also send the information about the pending cases for such revision to the Registrar General of this Court on the administrative side.

The suo motu PIL is accordingly, disposed of in terms of the above directions.

The parties as well as the Accountant General-II to act upon an ordinary copy of this order duly authenticated by Court Associate.
