3. This petition has been filed in public interest
challenging the decision of the respondent no. 1 for
purchasing property bearing survey no. 138 Hissa No.
4/2 which according to the petitioner at the relevant
time had a market value of Rs. 35,28,000/- but the
respondent has offered more price than the market price

and purchased it for Rs. 52,80,000/- resulting in loss
to the municipal fund and it smells of corrupt
practices in siphoning of public fund to the tune of
Rs. 20,68,800/-.
4. In response to the petition, the Chief Officer,
Chiplun Municipal Council has filed an affidavit
stating that the said plot of land was purchased by the
Municipal Council for disposal of solid waste as a
dumping ground and that every day 12 tons of garbage is
dumped on this plot of land. It appears that the
petitioner has moved this Court after the land was
purchased and notified as dumping ground. No material
is placed on record by the petitioner to show that the
land has been purchased at exorbitant price.
Therefore, in the facts and circumstances of the case,
we do not find that this is a fit case where this Court
should interfere in the matter in public interest. The
petition is, therefore, dismissed.
