2. It is submitted that during the course of adjudication before the Competent Authority various documents had been called for vide letter dated 15.12.2014 but the same could not be produced, inasmuch as, the said documents related to the period 1996-97 and 1997-98 and despite best efforts the applicant was unable to locate the same and file them before the Competent Authority. The said documents, which are in the nature of Bank Statements, Bank Certificates of Export Realisation, Books of Accounts of M/s High Tech Engineers etc. will go to prove that the properties belonging to the applicant, which have since been forfeited by the Competent Authority in terms of the order impugned herein dated 9.6.2016, were lawfully and bona fide acquired properties. Unfortunately, by the time the applicant could locate the said documents and file them before the Competent Authority, the present order was already passed, and as such, the Competent Authority had no occasion to consider the said documents at the time of passing the order impugned herein. In the premises, grave prejudice will be caused to the applicant if the said documents are not considered by the learned Members of this Appellate Tribunal since the same were also not considered by the Competent Authority and the applicant most humbly beseeches the learned Members of this Appellate Tribunal to kindly permit the applicant to file the same and treat the same as part and parcel of the appeal filed by the applicant.
