The above mentioned misc. application has been filed by the respondent for affixing the market rent of the forfeited property bearing no. B-1/592, Janakpuri, New Delhi in compliance of order dated 09.06.2016 which indicates that the market rent of the suit property is Rs. 2,30,000/-. The contentions of the learned counsel for the appellant is that he has also verified the position with the property dealer and the rent of the property is Rs. 70,000/-. We have heard the oral submissions of the parties. It is not in the dispute that immovable property bearing no. B-1/592, Janakpuri, New Delhi is the residential property which is not FPA-39/DLI/2016 Page 1 of 2

contested by Shri D.S. Bisht, Joint Commissioner. The appellant has also undertaken before this court not to dispose off or create any third party right in the attached property. Without prejudice, the appellant shall deposit the sum of Rs. 70,000/- within two weeks from today as the market rent from the month of January, 2017, The actual rent would be considered on the next date of hearing, as Shri D.S. Bisht is to verify the market rent. In case the appeal is not decided by the next date of hearing; the appellant shall keep on depositing the same till the order is modified by this Tribunal.

The interim order shall continue subject to the said deposit.
