“ 6. In reply to para 9, I submit that some of the Mussalies/Attendeees of the Mosque without the approval of R.2/Wakf Boad had elected a Committee on 29.1.2016 headed by R.3 as its President. Having learnt of it, the District Inspector Wakfs of Visakhapatnam district addressed a Letter dated 9.3.2016 to R.2/Wakf Board to constitute a statutorily appointed committee and he had also sent a Report to the commissioner of Police on 23.12.2015 against R.3 and others for trying to meddle into the affairs of management of subject wakf unauthorisedly and disrupting the peaceful atmosphere. Based on the above report, the Police had filed the FIR and the case is under investigation. All these facts the petitioners are well-aware yet without any basis attributing inaction on the part of R.2 is not tenable. R.2/Wakf Board is taking all the measures to safeguard the properties to Wakf in the interëst of the community. It is taking time for R.2 to identify and appoint suitable and upright Managing Committee to manage the affairs of subject wakf, and till such time Wakf Board has taken over the direct management of subject wakf, and no other person or persons is in any manner at the helm of affairs as alleged in the present writ.”
