ORDER:-

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief.

“… to issue a writ, order or direction more particularly one in the nature of Mandamus declaring the action of the respondent No. 2 in not providing police protection to the petitioners from the hands of the respondents no. 4 and 5 and also further action of the 3rd respondent in trying to dispossess/interfere in the property in Sy. No. 95 towards East to West 60 feet North to South 50 feet in east side direction and North to South 57 feet in West side direction out of Ac 0 82 cents and item no. 2 in Sy. No.95 East to West 45 V2 feet North to South 57 feet and North to South 62 feet in west direction out of Ac.0.82 cents of the petitioners situated at Pedda Rangapuram Village fields, Pulivendula Municipality, YSR Kadapa District of the petitioner as illegal, arbitrary and violation of principles of natural justice and also violation of Articles 14, 21 and 300-A of

the Constitution of India and consequently direct the respondent no.2 to protect the lives of the petitioners from the hands of respondents no 4 and 5 and pass…”

Heard both sides.

At the time of hearing, the learned Assistant Government Pleader, on instructions, submits that basing on a report of the respondent No.5, a case has been registered against the petitioner herein. In pursuant of the registration of the case, police called the petitioner only for the purpose of investigation. He further submits that except for the purpose of investigation, the police are not interfering with the property disputes between the petitioner and the unofficial respondents.

Learned counsel for the petitioners submits that the petitioner No.1 filed suit in O.S.No.3 of 2024 on the file of the Junior Civil Judge, Pulivendla against the unofficial respondents herein and Civil Court granted ad-interim injunction restraining the respondents and their men from interfering with his peaceful possession and enjoyment of the petition schedule property, till filing of counter.

In view of the above facts and circumstances of

the case, the police are directed not to interfere with the

schedule property belonging to the petitioners.

With the above direction, the Writ Petition is

disposed of. No costs.

¶35

Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
