ORDER:-

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief.

“… to issue an order or direction more particularly one in the nature of the Writ of Mandamus declaring the action of the Respondents particularly Respondent No. 3 and Respondents 4 to 7 interfering with my property bearing Sy. No 2153 to an extent of Ac.2.50 cents of Nellore Bit1 Village Panchayat Nellore Rural Mandal near Revenue Colony SPSR Nellore District and calling frequently to the police station without any authority as illegal, arbitrary and high handed action cannot be justified in the eye of law and consequently direct the respondents not to interfere in respect of petitioners property in the interest of justice and to pass…”

Heard both sides.

At the time of hearing, the learned Assistant

Government Pleader, on instructions, submits that basing

on a representation of the respondent No.6, the police conducted preliminary inquiry and came to conclusion that the disputes between the petitioners and the unofficial respondents appear to be predominantly civil in nature and that the police advised both the parties to work out their remedies in accordance with law.

Learned counsel for the petitioners submits that the petitioners filed suit in O.S.No.183 of 2016 on the file of the Principal Junior Civil Judge, Nellore for Permanent Injunction against the unofficial respondents and others and the Civil Court decreed the suit on 21.11.2016 in their favour.

In view of the above facts and circumstances of the case, the police are directed not to interfere with the schedule property of the petitioners.

With the above direction, the Writ Petition is disposed of. No costs.

¶33

Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
