THE HON’BLE SRI JUSTICE V.SRINIVAS Criminal Revision Case No. 346 of 2014

ORDER:

This Criminal Revision Case is filed by the State challenging the order, dated 06.03.2012 in Crl.R.P.No.1 of 2012 passed by the learned Principal Sessions Judge, Kadapa, wherein the learned Sessions Judge allowed the revision setting aside the dismissal order passed in Crl.M.P.No.977 of 2011 in O.R.No.33 of 2011-2012 on the file of the learned Judicial First Class Magistrate Court, Sidhout.

Initially, the 3^rd party/owner of the motor cycle bearing No.AP 04 AG 4376 involved in F.R.O in O.R.No.33 of 2011-2012 filed a petition under Section 457 Cr.P.C. seeking for interim custody and the same was dismissed by the learned Magistrate. Challenging the same, a revision was preferred and the same was allowed vide order dated 06.03.2012 ordering return of vehicle for the petitioner/3^rd party. Challenging the same, the State preferred this revision.

The learned Assistant Public Prosecutor submitted that the revision petitioner suppressed the fact that the vehicle had already been confiscated by the Authorized Officer-cum-Assistant Conservator of Forests. Subsequently, the confiscated motorcycle bearing No.AP 04 AG 4376 was sold in a public auction by the Authorized Officer-cum-Assistant Conservator of Forests. Since property was already sold at the public auction in the year 2012, keeping this revision pending would serve no purpose.

Accordingly, this criminal revision case is dismissed.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
