The Writ Petition is filed seeking to declare the action of the 2^nd respondent in not releasing the TATA ACE vehicle bearing No.AP 39 U 6744 which is in the custody of the 4^th respondent to the petitioner for interim custody as illegal and arbitrary and consequently direct the respondents to release the TATA ACE vehicle bearing No.AP 39 U 6744 to the petitioner forthwith.

Heard learned counsel appearing for the petitioner and learned Assistant Government Pleader for Civil Supplies appearing for the respondents. With their consent, the Writ Petition is being disposed of at the admission stage.

The grievance of the petitioner is that he is the owner of Tata Ace vehicle bearing No.AP 39 U 6744 and eking out his livelihood by running the same. The 4^th respondent, on mere suspicion that the vehicle was transporting the PDS rice, seized the vehicle under mediators report dated 14.10.2021 and registered a crime as FIR No.265 of 2021 on the file of Inaguduru P.S. for the offences under Section 420 r/w 34 I.P.C. and under Section 7(1) of the E.C.Act. Petitioner made a representation to the 2^nd respondent on 4.12.2021 for release of the vehicle for interim custody. Aggrieved by non consideration of the said representation, the Writ Petition came to be filed.

Having regard to the facts and circumstances of the case, submissions of the learned counsel and on perusal of the material record, this Court, without going into merits of the matter, in the

interests of justice, felt it appropriate to dispose of the writ petition giving liberty to the petitioner to submit a comprehensive detailed representation to the 2^nd respondent seeking release of the subject vehicle within a period of seven (7) days from the date of receipt of a copy of this order. On such representation being made, the 2^nd respondent is directed to consider the same as per law as expeditiously as possible within a period of seven (7) days from the date of receipt of representation and pass appropriate reasoned orders and communicate the same to the petitioner.

With the above directions, the Writ Petition is disposed of. No order as to costs.

Pending Miscellaneous Petitions shall stand closed.
