Heard learned counsel for the revisionist and learned AGA for the State of U.P. as well as perused the record.

The instant revision has been preferred alongwith an application (C.M.A. No. 1/2025) seeking condonation of delay of 2812 days for the following main relief(s):-

"Where, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to allow the above noted revision and set aside the Impugned Judgment 23.09.2015 passed by the Learned Principal Judge Family Court District Sultanpur in Maintenance Suit No. 3451/2014 under section 125 Criminal Procedure Code Namely (Smt. Shakuntala, komal, vs. Ashok kumar), and Judgment 03.04.2025 passed by the Learned Principal Judge Family Court District Sultanpur in Suit No. 606/2023 under section 126 Criminal Procedure Code, after summoning the lower courts records or remand back the matter the learned court below for fresh order after providing adequate opportunity of hearing to the revisionist."

Vide order, under challenge, dated 23.09.2015 passed in Maintenance Case No. 3451/2014 filed under Section 125 Cr.P.C. (Smt. Shakuntala and another vs. Ashok kumar), the Principal Judge, Family Court, District Sultanpur (in short "Family Court") awarded Rs. 2200/- to the opposite party No. 2/Smt. Shakuntla w/o revisionist/Ashok Kumar and Rs. 500/- to the opposite party No. 3/Komal @ Anshika d/o revisionist/Ashok Kumar towards maintenance till she attains the age of majority. of the order dated 23.09.2015 reads as under:-

"मैंने प्रािथनी की ओर से की गयी एकपक्षीय बहस को सुना तथा पत्रावली का अवलोकन िकया।

प्रािथनी ने अपने कथनों के समथर्न में स्वयं का शपथ पत्र प्रस्तुत िकया है। उक्त शपथ पत्र से प्रािथनी के द्वारा प्राथर्ना पत्र अन्तगर्त धारा-125 दण्ड प्रिक्रया सिहता में िकये गये कथनों का समथर्न होता है। िवपक्षी की ओर से उक्त साक्ष्य के िवरूद्ध कोई साक्ष्य प्रस्तुत न करने के कारण, प्रािथनी की साक्ष्य अखिण्डत है। प्रािथनी के पास स्वयं के, भरणपोषण हेतु आमदनी का कोई संसाधन / आय नहीं है, िजससे वह अपना तथा बच्चे का भरण-पोषण करने में असमथर् है। प्रािथनी िवपक्षी की िववािहता पत्नी है तथा प्रािथनी संख्या 2 कुमारी कोमल उसकी पुत्री है। अतः िवपक्षी का नैितक दाियत्व होता है िक वह अपनी पत्नी तथा बच्चे का भरण-पोषण करे। ऐसी िस्थित में आवेिदका स्वयं अपने िलए तथा बच्चे के िलए अपने पित/िवपक्षी से भरण-पोषण हेतु एक िनिश्चत धनरािश प्राप्त करने की अिधकािरणी है। प्रािथनी का कथन है िक िवपक्षी की आमदनी 50,000/- रूपये है। आवेिदका द्वारा प्राथर्ना पत्र में िवपक्षी की जो आमदनी दिशत की गयी है तथा िवपक्षी द्वारा जो कायर् करने के सम्बन्ध में कथन िकया गया है, उसको दृिष्टगत रखते हुए, प्रािथनी संख्या-1 श्रीमती शकुन्तला देवी को 2200 रूपये, प्रािथनी संख्या 2 कुमारी कोमल को 500 रूपये प्रितमाह िवपक्षी से आदेश की ितिथ से भरण-पोषण भत्ता िदलाया जाना उिचत होगा।

प्राथर्ना पत्र अन्तगर्त धारा-125 दण्ड प्रिक्रया संिहता एकपक्षीय रूप से अंशतः स्वीकार िकया जाता है। िवपक्षी अशोक कुमार यादव को आदेिशत िकया जाता है िक वह आदेश की ितिथ से प्रािथनी संख्या-1 श्रीमती शकुन्तला देवी को 2200 रूपये, प्रािथनी संख्या 2 कुमारी कोमल को 500 रूपये प्रितमाह, भरण-पोषण भत्ता प्रत्येक माह की सात तारीख तक अदा करे। प्रािथनी संख्या 2 वयस्क होने तक उक्त भरण-पोषण की धनरािश प्राप्त करने की अिधकारी होगा।"

The revisionist has also challenged the order dated 03.04.2025 passed by the First Additional Principal Judge, Family Court, Sultanpur (in short "Ist Family Court") in case No. 606 of 2023 (Ashok Kumar vs. Smt. Shakuntala Devi) under Section 126 Cr.P.C. The relevant portion of the order dated 03.04.2025 reads as under:-

"पत्रावली के अवलोकन से स्पष्ट है िक िवपक्षी श्रीमती शकुन्तला देवी द्वारा आवेदक/िवपक्षी अशोक कुमार के िवरूद्ध अन्तगर्त धारा 125 द०प्र०सं० का मुकदमा दायर िकया गया, िजसमें िदनांक 23.09.2015 को एक पक्षीय िनणर्य पािरत िकया गया। आवेदक द्वारा स्वयं अपने प्राथर्नापत्र में यह कथन िकया गया है िक उसके द्वारा पूवर् में भी धारा 126 द०प्र०सं० का वाद दायर िकया गया था जो िदनांक 05.10.2018 को उसकी गैर हािजरी में िनरस्त कर िदया गया। उल्लेखनीय है िक यह वाद िदनांक 27.04.2023 को अथार्त लगभग 5 वषर् बाद न्यायालय में प्रस्तुत िकया गया है। आवेदक द्वारा आदेश िदनांिकत 05.10.2018 को िनरस्त करने हेतु कोई कायर्वाही नही की गयी। आवेदक द्वारा यह भी कथन िकया गया है िक पैसे का इंतजाम करने के बाद यह वाद प्रस्तुत िकया गया जो संतोषजनक प्रतीत नही होता है। न्यायालय को यह भी देखना आवश्यक है िक िकसी पक्ष द्वारा प्रिक्रया का दुरुपयोग न िकया जाये। इस मामले में िवपक्षी/वािदनी को 2,200/- रुपये तथा वादी सं० 2 को 500/- प्रितमाह िदये जाने का आदेश िदनांक 23.09.2015 को पािरत िकया गया है। िवपक्षी/वािदनी द्वारा धारा 128 द०प्र०सं० का वाद िदनाकं 25.05.2016 से प्रस्तुत िकया गया है, िजसमें भी लगातार पैसा आवेदक/िवपक्षी द्वारा नही िदया जा रहा है। आवेदक ने अपनी अनुपिस्थित के सम्बन्ध में जो आधार िलया है वह िकसी भी प्रकार से सन्तोषजनक प्रतीत नहीं हो रहा है तथा उसके आचरण से यह स्पष्ट है िक उसके द्वारा जानबूझकर िविधक कायर्वाही समय से नहीं की गयी है एवं न ही िदन प्रितिदन िवलम्ब का कोई सन्तोषजनक स्पष्टीकरण िदया गया है तथा आवेदक को बाद की सम्पूणर् जानकारी वषर् 2018 में हो

गयी थी तथा जानकारी होने के उपरान्त उसका जानबूझकर अनुपिस्थत होना स्पष्ट हो रहा है। जबिक धारा-5 पिरसीमा अिधिनयम का लाभ सुनवाई के सम्बन्ध में उसी िस्थित में िदया जा सकता है जबिक िवलम्ब चाहने वाला पक्षकार िदन प्रितिदन के िवलम्ब को सन्तोषजनक कारण से स्पष्ट करें तथा उसके आचरण से उसकी सद्भािवकता स्पष्ट होती हो। प्रस्तुत मामले में आवेदक का आचरण इस प्रकार का प्रतीत हो रहा है िक वाद की जानकारी के बाद वह अनुपिस्थत रहा तथा जानबूझकर अपना पक्ष नही रखा। इस प्रकार आवेदक द्वारा अपने धारा 5 पिरसीमा अिधिनयम व धारा-126 द०प्र०सं० के प्राथर्ना पत्र में िलया गया आधार िकसी रूप में िवश्वसनीय व संतोषजनक प्रतीत नहीं हो रहा है तथा इस कारण िवपक्षी को धारा 5 पिरसीमा अिधिनयम का कोई लाभिदये जाने का कोई न्याियक आधार नहीं है तथा उसकी ओर से प्रस्तुत प्राथर्ना पत्र अन्तगर्त धारा-5 पिरसीमा अिधिनयम एवं प्राथर्ना पत्र 126 दं०प्र०सं० इस कारण िनरस्त िकये जाने योग्य है।

आवेदक अशोक कुमार की ओर से प्रस्तुत प्राथर्नापत्र अन्तगर्त धारा-5 पिरसीमा अिधिनयम एवं धारा-126 द०प्र०सं० िनरस्त िकया जाता है। पत्रावली िनयमानुसार दािखल दफ्तर हो।"

For condoning the delay, following averments have been made in the affidavit filed in support of the application seeking condonation of delay:-

"3. That the impugned order has never served to the applicant/revisionist due to this petitioner have no knowledge of the impugned order.

4. That the opposite party had filed application for under section 126 Cr.P.C. in the year 2018 and was dismissed vide order dated 05.10.2018.

5. That again the opposite party no.2 has filed application under section 126 Cr.P.C to suit no 606/2023 was dismissed vide order dated 03.04.2025.

6. That the opposite party has never communicated, the impugned order and for this she has filed application for seeking permission to send the notice to the applicant.

7. That the applicant has got the certified copy of the gram panchayat certificate was given to the daughter, who has been residing house with the revisionist.

8. That the applicant is not well finically sound and have no stable source of income, that's

why he was unable to arrange therefore and expenses to file this revision within time.

9. That the applicant had after arranging the money contacted to advocate and there after the revision has prepared by the counsel.

10. That there after the petitioner has come in to knowledge of the fact that the impugned order has passed by the learned court below and there after the applicant is challenging the impugned order on given grounds.

11. That it is respectfully submitted that from the 14.08.2025 to 17.08.2025, the Hon'ble

Court was closed in Independence day vacation.

12. That the applicant came after the vacation and given file to counsel to prepare the case

and there after came to swear the affidavit on 18.08.2025 and the revision is filing without any further delay."

Upon due consideration of the facts indicated in the application seeking condonation of delay of 2812 days including related to preferring the application under Section 126 Cr.P.C. by the revisionist and also the observations made by the Ist Family Court in the order impugned dated 03.04.2025, this Court finds that no interference is required in the instant matter. It for the reason that after the final order dated 23.09.2015, an application was preferred by the revisionist under Section 126 Cr.P.C., which was dismissed for want of prosecution on 05.10.2018 and thereafter, another application under Section 126 Cr.P.C. was preferred by the revisionist on 27.04.2023 i.e. delay of about 5 years and the explanation in this regard is not sufficient.

Taking note of the aforesaid, this Court finds that the application seeking condonation of delay of 2812 days in challenging the order dated 23.09.2015 passed by Family Court is liable to be rejected. It is accordingly rejected. Consequently, the instant revision is dismissed . Cost made easy.
