Heard learned counsel for the revisionist, learned A.G.A. for the State and perused the material available on record.

The revision has been filed for the following relief:-

"WHEREFORE, it is most respectfully prayed that this Hon'ble Court may be pleased to summon the lower court record and after perusal of the same allow the present criminal revision setting aside the impugned judgment and order dated 15.05.2025 passed by Principal Judge, Family Court, Ambedkar Nagar in Maintenance Case No.24 of 2021 (C No.38/2021) "Anju Verma Versus Indra Prakash Verma" under section 125 Cr.P.C., Police Station- Ahirauli, District- Ambedkar Nagar, in the interest of justice."

Considered the fact(s) that the final order dated 15.05.2025 passed by Principal Judge, Family Court, Ambedkar Nagar in Maintenance Case No.24 of 2021 (C.No.38/2021) (Anju Verma Vs. Indra Prakash Verma) has been challenged on the documents submitted by the revisionist with list of documents (34 ब/1) and in regard to the documentary evidence filed along with this list of documents the facts were not pleaded in the written statement, which could be pleaded by way of moving an application for amendment, as also the law related to considering the evidence, according to which the concerned court is not under obligation to consider the evidence in relation to which facts have not been pleaded.

Upon due consideration of aforesaid, on being confronted, the learned counsel for the revisionist says that the present revision be consigned to record with liberty to the revisionist to avail the remedy available under the law including preferring an application in terms of Section 125(5) Cr.P.C.

In view of the aforesaid, the present revision is consigned to record .
