सूची पुनरीिक्षत वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र, आवेदक की ओर से मु.अ.सं० 413/2025 अन्तगर्त धारा 137(2)/ 87/ 64(2)(एम)/ 115(2)/ 351(2) बी.एन.एस. एवं धारा 5एल/6 पॉक्सो एक्ट, थाना शाहगंज, िजला आगरा में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

आवेदक के िवद्वान अिधवक्ता, पिरवादी के िवद्वान अिधवक्ता आलोक िसह एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक को इस प्रकरण में गलत एवं फजीर् ढंग से झूठा फंसाया गया है, उसने किथत अपराध कािरत नहीं िकया है। िदनांक 11.08.25 घर से छाले की दवा लेने गयी थी, मेरे घर वाले मुझे मारते पीटते थे, तभी मैं घर से गुस्सा होकर चली गई थी मैं स्टेशन पर रुकी, उसके बाद मैं अपने घर िदनांक 20.08.2025 को जा रही ती तो मोहल्ले वालों ने बताया िक तुम्हारे गर वाले थान पर मुकदमा पंजीकृत कराया है तो मैं घर न जाकर थाने आ गयी, मैं िकसी के साथ नहीं गयी थी। मैं अपनी मजीर् से घर वालो से नाराज होकर चली गयी थी, न ही मेरे साथ कोई गलत काम हुआ है। यही मेरा बयान है। प्र०- आप िकसके साथ गयी थी। उ०- िकसी के साथ नहीं अपनी मजीर् से घर वालो से नाराज होकर गयी थी। प्र०- क्या आपके साथ कोई गलत काम हुआ है उ०-नहीं। पीिड़ता ने अपने अंतगर्त धारा 180 बी.एऩ.एस.एस. में कहीं भी यह कथन नहीं िकया की आवेदक द्वारा उसके साथ गलत िकया गया जबिक अंतगर्त धारा 183 बी.एन.एस.एस. में कथन िकया िक रास्ते में में नहीं िचल्लाई क्योंिक उसने चाकू लगा रखा था पानीपत में वह अपने िकरा के मकान पर ले गया उसने मुझे भूखा प्यासा रखा और मारपीट की रोिहत ने मेरे साथ गलत काम िकया था तीन चार िदन मुझे वहां रखा था िफर उसके बाद रोिहत मुझे अपने िपता संजय के साथ थाने पर छुड़वा िदया िपता के साथ दो अज्ञात है िजसका मुझे नहीं पता थाने पर रोिहत खुद नहीं आया था रोिहत और उसके घरवालों ने जान

से मारने की धमकी दी थी। उक्त 183 बी.एन.एस.एस. में पीिड़ता द्वारा जो वह रास्ते में चाकू लगा रखा था इसिलए नहीं िचल्लाई। यह कथन संिदग्ध प्रतीत होता है क्योंिक बस में तो इतनी भीड़ होती है अगर ऐसा िकया होता तो कोई और भी देखता। इसप्रकार पीिड़ता के बयान अंतगर्त धारा 180/183 बी.एन.एस.एस. में घोर िवरोध है। अिभयुक्त का कोई आपरािधक इितहास नहीं है। पुनः उनका कथन है िक आवेदक की ओर से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से अदालत के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतों को स्वीकार करने के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी। आवेदक िनदोर्ष है तथा वह इस प्रकरण में िद० 04.09.2025 से कारागार में िनरुद्ध है इसिलए आवेदक को जमानत पर छोड़ िदया जाय।

पिरवादी के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता ने आवेदक के िवद्वान अिधवक्ता के तकोर् का प्रबल िवरोध करते हुए तकर् प्रस्तुत िकया िक आवेदक द्वारा कािरत अपराध संज्ञेय एवं गंम्भीर प्रकृित का है , इसिलए आवेदक को जमानत पर न छोड़ा जाये।

आवेदक के िवद्वान अिधवक्ता के तकोर्ं के पिरप्रेक्ष्य प्रश्नगत प्रकरण में पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद , सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेदक को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण दोष पर िबना कोई िटप्पणी िकए हुए आवेदक को उपरोक्त विणत अपराध में संबंिधत न्यायालय की सन्तुिष्ट पर व्यिक्तगत बंध - पत्र एवं अिधक धनरािश के दो स्थानीय प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय।

आवेदक िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगा।

आवेदक अिभयोजन सािक्षयों व पीिड़ता / िशकायतकतार् को डरायेगा / धमकायेगा नहीं।

आवेदक न्यायालय के आदेशों का पालन करेगा , वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगा तथा परीक्षण में ईमानदारी से सहयोग करेगा।

आवेदक जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता का दुरूपयोग नही करेगा और िकसी भी अपरािधक गितिविध में िलप्त नहीं होगा न कोई अपरािधक कृत्य करेगा।

आवेदक प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों से पिरिचत िकसी भी व्यिक्त या पुिलस अिधकािरयों को कोई प्रलोभन या धमकी नहीं देगा न ही उनसे कोई वायदा करेगा, िजसके
