वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र आवेदक की ओर से मु०अ०सं० 135/2025, अन्तगर्त धारा 65(1), 351(2), 352 भारतीय न्याय संिहता एवं धारा 3/4 पाक्सो एक्ट, थाना सराय अिकल, िजला कौशांबी में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

आवेदक के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

कायार्लय आख्या, िदनांिकत 12.11.2025 के अनुसार सूचनाकतार्/िवपक्षी सं० 2 को व्यिक्त रूप से नोिटस तामील करायी जा चुकी है, िकतु उनके ओर से कोई उपिस्थत नहीं है।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक को इस प्रकरण में गलत एवं फजीर् ढंग से झूठा फंसाया गया है, उसने किथत अपराध कािरत नहीं िकया है। प्रथम सूचना िरपोटर् चालीस िदवस उपरांत पंजीकृत कराया गया है, इसका कोई समुिचत स्पष्टीकरण नहीं िदया गया है। प्रथम सूचनाकतार् द्वारा प्रथम सूचना िरपोटर् में किथत घटना िदनांक 20.04.2025 की शाम का उल्लेख करते हुए आवेदक के िवरूद्ध केवल छेड़खानी करने व धमकी देने का वणर्न िकया गया है। इस मामलें में प्रासंिगक तथ्य यह है िक किथत पीिड़ता द्वारा अपने धारा 180 भारतीय नागिरक सुरक्षा संिहता के बयान में किथत पीिड़ता द्वारा किथत घटना की ितिथ िदनांक 25.04.2025 की शाम 06 बजे की अिभकिथत की गयी है तथा अपने धारा 183 भारतीय नागिरक सुरक्षा संिहता के बयान में आवेदक के साथ, उसके दो अन्य दोस्तो के द्वारा किथत अपराध घटना कािरत करने का अिभकथन िकया गया है। इससे पिरलिक्षत हो रहा है िक प्रथम सूचना िरपोटर् व किथत पीिड़ता के धारा 180 व धारा 183 भारतीय नागिरक सुरक्षा संिहता के बयान में भारी िवरोधाभाष है। आगे यह भी कहा गया िक किथत पीिड़ता के िचिकत्सीय परीक्षण आख्या के अनुसार भी अिभयोजन कथानक का समथर्न नहीं हो रहा है। इसिलए, आवेदक जमानत पर मुक्त िकये जाने योग्य है। पुनः उनका कथन है िक आवेदक की ओर से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया

में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से अदालत के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतोर्ं को स्वीकार करने के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी। आवेदक िनदोर्ष है तथा वह इस प्रकरण में िद० 21.06.2025 से कारागार में िनरुद्ध है। इसिलए आवेदक को जमानत पर छोड़ िदया जाय।

िवद्वान अपर शासकीय अिधवक्ता ने अिभयुक्त के जमानत का प्रबल िवरोध करते हुए तकर् प्रस्तुत िकया िक अिभयुक्त द्वारा कािरत अपराध स ं ज्ञेय एवं गंभीर प्रकृित का है, इसिलए अिभयुक्त को जमानत पर न छोड़ा जाय।

उभय पक्ष के िवद्वान अिधवक्ता के तकोर्ं के पिरप्रेक्ष्य एवं पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद, सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेदक को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण-दोष पर िबना कोई िटप्पणी िकए हुए आवेदक को उपरोक्त विणत अपराध में संबंिधत न्यायालय की संतुिष्ट पर व्यिक्तगत बंध-पत्र एवं अिधक धनरािश के दो स्थानीय प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय।

आवेदक िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगा।

आवेदक अिभयोजन सािक्षयों व पीिड़ता/ िशकायतकतार् को डरायेगा/धमकायेगा नहीं।

आवेदक न्यायालय के आदेशों का पालन करेगा, वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगा तथा परीक्षण में ईमानदारी से सहयोग करेगा।

आवेदक जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता का दुरूपयोग नही करेगा और िकसी भी अपरािधक गितिविध में िलप्त नहीं होगा न कोई अपरािधक कृत्य करेगा।

आवेदक प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों से पिरिचत िकसी भी व्यिक्त या पुिलस अिधकािरयों को कोई प्रलोभन या धमकी नहीं देगा न ही उनसे कोई वायदा करेगा, िजसके कारण उन्हें न्यायालय में तथ्यों को उजागर करने से िवरत रहना पडे़।

उपरोक्त शतोर्ं में से िकसी के उल्लंघन के मामले में, िवचारण न्यायालय आवेदक की जमानत िनयमानुसार रद्द करने को स्वतंत्र है।
