The matter arises out of a private dispute between the parties. The applicants were chargesheeted under Sections 323, 506 I.P.C. by chargesheet dated 05.06.2023 and the cognizance of the said offence was taken by the learned trial court by order dated 19.10.2023. The offences are compoundable in nature.

Shri Vijay Kumar Tiwari, learned counsel for the applicant and Shri Shiv Kumar Yadav, learned counsel for the opposite party no. 2 submit that the parties have amicably resolved the dispute through the process of mediation at Mediation & Conciliation Centre, High Court Lucknow Bench, Lucknow and have arrived at a compromise. The parties do not wish to continue with the prosecution of the criminal case in view of the aforesaid compromise. A report to this effect has been sent by the Mediation & Conciliation Centre, High Court Lucknow Bench, Lucknow.

In these circumstances permitting the criminal proceedings to continue will not only cause unnecessary harassment to the parties, but would also entail waste of precious time and resources of the Court.

In view of the aforesaid compromise and the fact that the aforesaid offences are compoundable in nature the entire proceedings arising out of Case Crime No. 200/2023 under Section 323, 506 I.P.C. Police Station Gazipur, District Lucknow, impugned chargesheet No. 01 dated 05.06.2023 and cognizance/summoning order dated 19.10.2023 passed by the learned Special CJM Custom, Lucknow, are quashed.

The Application U/S 482 is allowed.
