Learned A.G.A. submitted that a prima facie case was disclosed against the applicant as beneficiary of the offending transactions. Faced with this, counsel for the applicant did not press the original prayer and confined the request to liberty for the applicant to approach the trial court for an interim bail/bail application to be processed expeditiously and as per law; the A.G.A. had no serious objection. Disposing of the application, the Court directed (i) that the applicant may approach the trial court for interim bail/bail as advised, and (ii) that the trial court decide the interim bail/bail application expeditiously as per relevant holdings of constitutional Courts, including the law laid down by the Supreme Court in Satendra Kumar Antil v. Learned A.G.A. submits that the a prima facie case is disclosed against the applicant, inasmuch as, he was the beneficiary of the offending transactions. Prima facie, the ingredients of the offence are satisfied in the facts and circumstances of this case.

Faced with this, Shri Shiv Kumar Vishwakarma, learned counsel for the applicant submits that he does not wish to press the prayer sought in the application and recasts the relief. The only prayer made by the learned counsel for the applicant is that the applicant may be permitted to approach the learned trial court for interim bail application/bail application which may be processed expeditiously and as per law.

Shri Anurag Verma, learned A.G.A. does not have any serious objection to the aforesaid prayer.

In wake of the preceding submissions, interest of justice will be served by disposing of the application with the following directions:

(i). The applicant may approach the learned trial court for grant of interim bail/bail application as may be advised.
