This application under Section 482 Cr.P.C./528 B.N.S.S. has been filed for quashing of the summoning order dated 24.04.2025 passed by Chief Judicial Magistrate, Ambedkar Nagar as well as to quash the charge-sheet No. A 28/2025 dated 01.03.2025 and criminal proceedings arising out of Case Crime No. 23/2025, under Section 115(2), 352, 351(3) B.N.S., Police Station Ahirauli, District Ambedkar Nagar.

Learned A.G.A. contends that a prima facie case is disclosed against the applicants in respect of the offences, in which they have been charge-sheeted. The specific allegations of assault are corroborated by medical evidence is on record.

Faced with this, Sri Ijamamul Hak, Advocate holding brief of Sri Saad Mohd. Khan, learned counsel for the applicants submit that he does not wish to press the prayer sought in the application.

The prayer sought in the application is accordingly

Learned counsel for the applicants recasts his relief and submits that the applicants may be permitted to approach the learned trial court for bail/interim bail which may be processed expeditiously and as per law.

In wake of the preceding submissions, interest of justice will be served by disposing of the application with the following directions:

(i). The applicants may approach the learned trial court for grant of bail/interim bail as may be advised.

(ii). The learned trial court is directed to decide the application for bail/interim bail expeditiously as per relevant holdings of various constitutional Courts including the law laid down by the Supreme Court in Satendra Kumar Antil Vs. Central Bureau of Investigation and another , rendered in Special Leave to Appeal (Crl.) No.5191 of 2021 .
