Heard learned counsel for petitioner, learned State Counsel for opposite party no.1, Mr. Ravi Singh, learned counsel for opposite party no.2, Mr. Anagh Shukla, learned counsel for opposite party no.3.

Petition has been filed seeking a direction to the State Government to pass appropriate order for grant of affiliation in favour of petitioner for conducting D. Pharma Course in accordance with the Government Order dated 05.01.2024 read with Section 23(2) of the U.P. Technical University Act, 2000 in terms of recommendation made by the Technical University concerned for Academic Sessions 2024-25.

Learned counsel for petitioner submits that approval for conduct of aforesaid course has already been granted by the Pharmacy Council of India and appropriate orders are required to be passed regarding affiliation by the State Government which has not yet been done. Urgency has been indicated in the matter in view of schedule indicated by Supreme Court in the case of Parshvanath Charitable Trust and others versus All India Council for Technical Education and others Civil Appeal No.9048 of 2012 and 9047 of 2012.

Learned State Counsel, on the basis of instructions, submits that no schedule for counseling as yet has been intimated pertaining to counselling.

Learned State Counsel has been provided written instructions dated 07.12.2024, a copy of which has been taken on record and as per which petitioner's name has also been included as one of the institutes requiring affiliation. It is submitted that the decision in the aforesaid shall be taken very shortly.

In view of aforesaid, opposite party no.1 is directed to take final decision with regard to petitioner's application for affiliation in terms of recommendations made by Technical University expeditiously keeping in view the timeline prescribed by Supreme Court in the case of Parshvanath Charitable Trust (supra).

With the aforesaid, the petition is disposed of .
