Mr. Anurag Kumar Singh learned counsel for petitioner submits that he does not have any instructions in this matter since the petitioner has not contacted him with regard to filing of rejoinder affidavit. Time for filing rejoinder affidavit has been granted earlier. In view of aforesaid, the petition is dismissed for want of instructions granting liberty to petitioner to file an appropriate application for restoration of petition in case cause of action survives.
