Heard learned counsel for the petitioner, learned State counsel for opposite party Nos. 1 & 2, Mr. Ravi Singh, learned counsel for opposite party No.3 and Mr. D.K. Singh Chauhan, learned counsel for opposite party No.4.

Petition has been filed seeking a direction to concerned authority, specifically U.P. Board of Technical Education to provide affiliation to petitioner institution for conducting the D.Pharma course for the academic session 2024-25.

Sri Rahul Shukla, learned State counsel has been provided written instructions dated 05th December, 2024 by the Secretary of the Board, a copy of which is taken on record and as per which the petitioner institution has already applied in a offline mode for grant of affiliation after approval having been granted by the Pharmacy Council of India. The instructions advert to the fact that in pursuance of the application, a site inspection would take place and necessary orders regarding petitioner's application for affiliation would be passed on the report being submitted.

Learned State counsel has also adverted to order dated 04th December, 2024 issued by the Secretary of the Board, copy of which is also taken on record to submit that Committee has already been constituted for the purposes of such inspection and is required to submit its report by 10th December, 2024 after making inspection on 09th December, 2024, particularly with regard to the petitioner institute.

In view of the aforesaid written instructions and submissions of learned State counsel, it is evident that the process of consideration of petitioner's application for affiliation is yet on going with specific time frame having been fixed for report of

the Inspection Committee to be submitted.

In view thereof, there does not appear to be any occasion to issue any specific directions when the opposite parties have already taken cognizance of the aforesaid fact.

It is however provided that concerned authority being the opposite party No.2- U.P. Board of Technical Education shall take a decision with regard to petitoner's application for affiliation for D. Pharma course for the academic session 202425 expeditiously, prior to the commencement of counselling, upon such report being submitted on 10th December, 2024.

With the aforesaid directions, petition stands disposed of.
